Terms and conditions
1. The Promoter
1.1 The promoter is: Grand Central Railway Company Limited of River House, 17 Museum Street, York YO1 7DJ (the “Promoter”)
2. The competition
2.1 The title of the competition is The 2015 Grand Central Heart of the Community Awards (the “Competition”).
2.2 The Competition aims to find and recognise those people that have made contributions to the communities situated along the Grand Central Railway route [/tickets-timetables/routes/]. The Promoter is calling on residents of Yorkshire and the North East to nominate community heroes for their chance to win the Competition.
3. How to enter
3.1 The Competition will run from 09:00 on Wednesday 12 August 2015 (the "Opening Date") to 17:00 on Monday 14 September 2015 (the "Closing Date") inclusive.
3.2 All Competition entries must be received by the Promoter by no later than 17:00 on the Closing Date. All Competition entries received after the Closing Date are automatically disqualified.
3.3 To nominate someone to be entered into the Competition:
3.4 Choose someone that you feel has made a difference to their community (a “Nominee”) (such Nominee must reside in Yorkshire or the North East and complete an entry form available at [INSERT WEB LINK TO ENTRY FORM PAGE]. No purchase is necessary and there is no charge to register for use of the website. For the avoidance of doubt, you may complete an entry form nominating yourself as a Nominee. However if your chosen Nominee is someone other than yourself and is selected as a Shortlisted Nominee, you are responsible for obtaining their consent to being involved in the Competition. Should your Nominee not provide their consent, an alternative Nominee will be selected as a Shortlisted Nominee and your entry will be disqualified. The entry form can either be emailed to firstname.lastname@example.org or posted to Grand Central, Heart of the Community Awards, Grayling, Bramley Grange, Skeltons Lane, Leeds, LS14 3DW. Only one entry per person is permitted.
3.5 The Promoter will not accept:
- (a) responsibility for Competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
- (b) proof of posting or transmission as proof of receipt of entry to the Competition.
3.6 By submitting a Competition entry, you are agreeing to be bound by these terms and conditions.
3.7 During w/c 21 September 2015 eight Nominees will be shortlisted by an independent panel of judges based on information provided in the entry forms (the “Shortlisted Nominees”). Four of the Shortlisted Nominees will currently reside in the areas covered by Grand Central’s North East Route [North East and North Yorkshire] and the other four Shortlisted Nominees will currently reside in the areas covered by Grand Central’s West Riding Route [West Yorkshire and South Yorkshire]. The decision of the panel of judges (acting reasonably) will be final.
3.8 Using the detail provided on the entry form, the Shortlisted Nominees will be notified by telephone or email during w/c 21 September 2015 and be invited to an awards ceremony at the Hepworth Gallery, Wakefield on Wednesday 28 October 2015 at 18:00 (the “Awards Ceremony”). Each Shortlisted Nominee shall receive four tickets to attend the Awards Ceremony.
3.9 In the event that a Shortlisted Nominee is unable to attend the Awards Ceremony, then he/she may (subject to giving the Promoter prior reasonable notice) nominate someone to attend the Awards Ceremony on his/her behalf (the “Nominated Representative”).
3.10 At the Awards Ceremony two winners will be announced by the panel of judges from the Shortlisted Nominees based on the entry form provided and additional information collected by Grand Central by telephone (the “Winners”). One Winner will reside in the locations covered by Grand Central’s North East route [North East and North Yorkshire] and the second Winner will reside in the locations covered by Grand Central’s West Riding Route [West Yorkshire and South Yorkshire]). The decision of the panel of judges (acting reasonably) will be final.
3.11 The Promoter will send the full names of the judges to anyone who writes within one month of the Closing Date requesting details of the judges and who encloses a self-addressed envelope to Grand Central Heart of the Community Awards, Grayling, Bramley Grange, Skeltons Lane, Leeds, LS14 3DW
4.1 The Competition is only open to those residents in Great Britain aged 18 years or over living along the Grand Central routes [/tickets-timetables/routes/], except:
- (a) employees of the Promoter or its holding or subsidiary companies;
- (b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Competition or its administration; or
- (c) members of the immediate families or households of (a) and (b) above.
4.2 In entering the Competition, you confirm that you are eligible to do so and that your Nominee is eligible to claim the Prize. The Promoter may require you to provide proof that you are eligible to enter the Competition and proof that your Nominee is eligible to claim the Prize.
4.3 The Promoter will not accept Competition entries that are:
- (a) automatically generated by computer;
- (b) completed in bulk;
- (c) illegible, have been altered, reconstructed, forged or tampered with; or
- (d) incomplete.
4.4 The Promoter reserves all rights to revoke your entry into the Competition if either your or your Nominee’s conduct, is contrary to the spirit or intention of the Competition.
5. The prize
5.1 There will be two Winners.
5.2 Each Winner will receive:
- (a) Four Grand Central return train tickets to London Kings Cross Station (leaving from one of the following train stations: Sunderland, Hartlepool, Eaglescliffe, Northallerton, Thirsk, York, Bradford Interchange, Halifax, Brighouse, Mirfield, Wakefield Kirkgate, Pontefract Monkhill or Doncaster). Winners must provide the Promoter with ten working days’ notice prior to their proposed date of travel;
- (b) One night’s accommodation for four people in Central London;
- (c) Four tickets to The London Bridge Experience & Tombs and
- (d) £500 (in the form of a cheque) to be donated to the charity of the Winners’ choice (such charity to be notified by the Winners to the Promoter within one week of the Awards Ceremony) (together the “Prize”).
5.3 The Prize must be claimed and used by the Winners within six months from the date of the announcement of the Winners at the Awards Ceremony.
5.4 Each Winner will be responsible for ensuring that they and any person travelling with them are available to travel and hold any necessary documents.
5.5 Prizes are subject to availability. There is no cash alternative for the Prize. The Promoter reserves the right to substitute the Prize with a prize of equal or greater value.
5.6 The Prize is not negotiable or transferable.
5.7 The Shortlisted Nominees not to win the Prize (the “Runners Up”) will each receive a pair of Standard Class return train tickets on a Grand Central service from one of the following stations: Sunderland, Hartlepool, Eaglescliffe, Northallerton, Thirsk, York, Bradford Interchange, Halifax, Brighouse, Mirfield, Wakefield Kirkgate, Pontefract Monkhill or Doncaster to London King’s Cross. The Runners Up must claim and use these tickets within six months of receiving notification by the Promoter of their entitlement to these tickets.
6. Winner announcement
6.1 The Winners and Runners Up of the Competition will be announced at the Awards Ceremony (Announcement Date).
6.2 The decision of the judges nominated by the Promoter is final and no correspondence or discussion will be entered into.
6.3 The Promoter will send the name and county of the Winners to anyone who writes within one month of the Announcement Date requesting details of the Winner and who encloses a self-addressed envelope to the address set out in condition 1
7. Claiming the prize
7.1 The Winners will be presented with their Prize at the Awards Ceremony. In the event that a Winner is not in attendance at the Awards Ceremony, then:
- (a) subject to the provisions of clause 3.9, the Prize may be collected on the Winner’s behalf by his/her Nominated Representative; or
- (b) the Promoter shall notify the Winner in writing within 30 days of the Closing Date of the fact that they have won the Competition, providing them with details of how to claim the Prize.
7.2 The Promoter will not take responsibility for lost tickets and replacements cannot be issued.
7.3 The Promoter does not accept any responsibility if you are not able to take up the Prize.
8. Limitation of liability
8.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Winners or Runners Up or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Statutory rights are not affected.
9. Data protection and publicity
9.1 If your entry form is selected as a Winner of the Competition, you agree that the Promoter may use your name, image and town or county of residence in connection with this Competition and for any other reasonable and related promotional purposes.
9.2 You further agree to participate in any reasonable publicity required by the Promoter.
9.3 By entering the Competition, you agree that any personal information provided by you with the Competition entry may be held and used only by the Promoter or its agents and suppliers to administer the Competition.
10.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude your entry from the Competition.
10.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the Competition where it becomes necessary to do so.
10.3 These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
